Three Arrested After Drugs Discovered During Probation Search

Three people were arrested following a probation search that led to the discovery of drugs Wednesday, January 4.

Sgt. Junior Fields of the Smith County Sheriff’s Office, along with Chief Britt Davis of the Carthage Police Department, Sgt. Dusty Hailey and Deputy Jake Oneal went to a McGinness Avenue residence to conduct a probation search of Devonta Milan (20, Carthage).

Upon arrival, Fields spoke to Thomas Milan (36, Carthage), who met the officers on the front porch of the residence, at which time Fields and Hailey noticed an odor of marijuana, according to the arrest warrant.  Fields explained to Milan why they were there and advised him they would be conducting a probation search.

According to the arrest warrant, Thomas Milan had two marijuana cigarettes, at which he handed one of them to Fields, and the other was located in the living room laying on the coffee table, along with a pill bottle containing two 10 mg Oxycodone pills.

Hailey and Davis located a cigarette pack in Devonta Milan’s room with a marijuana cigarette and two pieces of straw with powder residue inside them, according to the arrest warrant.

According to the arrest warrant, a pill bottle containing 7 1/2 1 mg Alprazolam (Xanax) pills and five 10 mg Oxycodone pills were found to be in Melanie Elrod’s (44, Carthage) possession, who was also present at the residence.

Located on Devonta Milan’s phone were numerous messages referencing drug deals where people allegedly contacted him and would come to his residence to pick up marijuana, according to the arrest warrant.

According to the arrest warrant, Devonta Milan admitted to having possessed marijuana and that the marijuana cigarette, along with the cut straws, were in fact his.  According to the arrest warrant, Milan further advised that two days prior, he had delivered marijuana to a person in Carthage near the city pool.

Devonta Milan, Thomas Milan and Melanie Elrod were all placed under arrest and transported to the Smith County Jail Facility for booking.

Devonta Milan is charged with felony possession of drug paraphernalia, felony criminal conspiracy and possession of controlled substances.

Thomas Milan is charged with felony criminal conspiracy, two counts of possession of controlled substances and felony possession of drug paraphernalia.

Melanie Elrod is charged with two counts of possession of controlled substances.
