An East Tennessee man travelling through Smith County on Interstate 40 was arrested on DUI and drug charges following a traffic stop for speeding Sunday, March 12.
Trooper Brandon Jackson of the Tennessee Highway Patrol initiated a traffic stop on a vehicle speeding at 85 mph in a 70 mph zone near mile marker 258.
Upon contact with the driver, identified as 51-year-old Derek Davenport of Maryville, Tennessee, Jackson noticed a strong odor of marijuana coming from the vehicle and observed Davenport as having red, watery eyes and an odor of marijuana coming from his breath, according to the arrest warrant.
According to the arrest warrant, Davenport admitted to smoking marijuana approximately two hours before he was stopped by Jackson.
Davenport submitted to six Standardized Field Sobriety Tests (SFSTs), of which he performed poorly on five of them, according to the arrest warrant.
According to the arrest warrant, a plastic bag was found in the right jacket pocket of Davenport’s teenage daughter containing .42 ounces of marijuana. While being questioned by Jackson, Davenport stated the marijuana was his and that he had told her to put it there as he was being stopped, according to the arrest warrant.
During a search of the vehicle, another bag of marijuana was located in the center console weighing approximately .16 ounces. Two cigars, identified as paraphernalia, were located in the glove compartment.
Davenport was arrested and transported to the Smith County Jail Facility for booking.
He is charged with manufacture/delivery/sell of a controlled substance, felony possession of drug paraphernalia, driving under the influence and contributing to the delinquency of a minor.
