A Brush Creek woman faces various charges following a domestic altercation.
Sgt. Jimmy Gregory and Deputy Kendra Kunstman of the Smith County Sheriff’s Office were dispatched to a Paschall Road residence on the night of Thursday, December 22, for a domestic altercation involving the use of knives as weapons.
Upon arrival, Kunstman and Gregory made contact with Tim Bates in the front yard.
According to the arrest warrant, Bates stated that he and his wife returned home from the store around 11:45 p.m. and began discussing plans to rent a hotel room once his paycheck arrived.
Bates then stated that at this time, his step daughter, 42-year-old Francene Abston, came out of a back room and began yelling at him, asking if he was “talking crazy” to her mom, according to the arrest warrant
According to the arrest warrant, Bates stated that Abston pulled a knife and began advancing toward him, stating that she would “cut him.” He stated that he was in fear of his safety and retrieved his hunting knife to protect himself, but at no time did he or Abston physically harm one another, according to the arrest warrant.
Upon making contact with Abston and confirming that she was not in possession of a weapon, she stated that she was in the back room of the residence when her mother and step father came home, according to the arrest warrant. She stated that her step father was being disrespectful toward her mother and that she became upset. At that time, she emerged from the back room brandishing a knife and stated to Bates that she would “cut him,” according to the arrest warrant.
According to the arrest warrant, it was determined that Abston was the primary aggressor in the altercation and was subsequently arrested for aggravated domestic assault and transported to the Smith County Jail Facility for booking.
Inside Abston’s purse, a small baggy containing a white powdery substance and a prescription bottle were later located. Inside the pill bottle was Abston’s prescription Alprazolam, which were blue and round. Also located inside the bottle were four blue/oblong Alprazolam tablets which, according to the label, were not prescribed to Abston. After field testing the white powder, it was determined to be cocaine.
In addition to the aggravated domestic assault charge, Abston is also charged with possession of schedule IV and possession of schedule II.
